MARDELL GROUP PRIVACY POLICY
INTRODUCTION
At Mardell Group Pty Ltd ACN 662 193 553 (Mardell, we, us) we are committed to protecting your privacy when managing the personal information you provide us. Mardell has adopted this Privacy Policy to ensure that all personal information is handled in accordance with the Australian Privacy Principles (APPS) contained in the Privacy Act 1988 (Cth) (Privacy Act) . For the purposes of this Privacy Policy, “personal information” has the same meaning as in the Privacy Act.
COLLECTION OF INFORMATION
Personal information
The personal information collected by Mardell is directly related to the provision of our services to you. Mardell will generally request:
(i) Your company and contact details, your trade reference and your payment details, if you are procuring our services;
(ii) Your name and contact details if you are making an enquiry or providing feedback to us; or
(iii) Your name, contact details and the information contained in your resume, if you are applying for employment with us.
Mardell may need to request further particulars to help us respond to you, however, the amount of personal information that you choose to disclose to us is completely up to you. Please note that failure to provide certain information may result in Mardell being unable to provide you with the relevant assistance that you are seeking.
You warrant that the personal information we collect from you is true and correct and is either:
(i) your own information; or
(ii) third party information which you have been authorised to provide us by that third party.
Sensitive information
Mardell does not generally collect sensitive information as defined under the Privacy Act, such as racial or ethnicity information, political opinions or associations, criminal records or health information. Mardell will never collect this information without your consent.
Unsolicited information
Where unsolicited information is received by Mardell (such as through our social pages) we will determine, within a reasonable period of time, whether or not we would be permitted to collect the information under the APPs. If it would not be permitted for us to collect the information, we will destroy the information as soon as practicable. Otherwise, we may retain the information in accordance with the terms of this Policy.
Anonymous information
Mardell may collect information about visitors to its website, such as statistical information regarding visits, domains and URLs from which the website is accessed and IP addresses. However, Mardell does not collect information about the identity of visitors unless they voluntarily provide that information.
METHOD OF COLLECTION
Mardell collects your personal information when you deal with us directly and voluntarily provide that information, whether via our website or our social pages, via forms or email correspondence, over the phone or in person. Mardell will only collect personal information through lawful and fair means and not in an unreasonably intrusive way.
INFORMATION FROM THIRD PARTIES
You may choose to connect with Mardell using an external third-party application, such as Facebook, Google, or other third party accounts. Connecting with Mardell through a third-party application or service is optional. If you choose to use a third party application, it is subject to your agreement with that third party (such as their terms of use and privacy policy), and Mardell may receive relayed information from that third party.
USE OF INFORMATION
Use of personal information
Mardell will use the personal information you have chosen to provide us for:
(i) the purpose for which you provided the personal information; or
(ii) a related secondary purpose which you would reasonably expect.
Generally, Mardell will use your personal information for the following purposes:
(iii) providing the services you have requested from us;
(iv) processing payments;
(v) liaising with subcontractors;
(vi) managing claims;
(vii) responding to enquiries, feedback or complaints made by you;
(viii) providing direct marketing which may be of interest to you;
(ix) assisting us to improve our website or social pages;
(x) processing and assessing employment applications; and
(xi) otherwise managing our internal business operations and processes.
Mardell will not use your personal information for any other purpose without your consent, unless permitted or required by law. By providing your personal information you agree that Mardell may store, process and use such personal information for the purposes set out above and any related purposes.
Direct marketing
Mardell will only use your personal information for the purpose of direct marketing activities where we have obtained your consent to do so, or in circumstances where we have collected the information directly from you and you would reasonably expect that your personal information would be used or disclosed for such a purpose.
You may opt out of receiving marketing materials at any time by either unsubscribing from the email service or contacting our Privacy Officer via the contact details provided below.
Use of anonymous information
We gather anonymous information to:
monitor the use of our website;
help us make improvements to the website; and
offer relevant information and services to as many users as possible.
DISCLOSURE
There will be occasions where it will be necessary for Mardell to disclose your personal information to third parties.
Generally, we may disclose your personal information to:
subcontractors and third party service providers on a confidential basis that we use in the ordinary course of our business to assist with the delivery of our services. This includes organisations such as data processing companies, , delivery companies, data storage companies (which may use cloud computing storage systems which have the potential to make your personal information accessible by overseas entities), finance agencies or debt collection agencies;
government authorities, customs, third party carriers or other third parties as required by law; or
any other third party that you have consented to the disclosure to.
TRANSFER OF INFORMATION OUTSIDE AUSTRALIA
Mardell may transfer your personal information to service providers who will hold your information on a cloud computing system which may hold your data on servers located outside of Australia. However, where your personal information is disclosed to an overseas recipient or a cloud computing system, we will take adequate measures to ensure that your personal information is handled in accordance with the APPs, the Privacy Act and our instructions in accordance with this Privacy Policy. By providing us with your personal information, you consent to your personal information being stored or sent overseas for the purposes set out in this Policy.
Otherwise than stated above, we do not disclose personal information that you may give us to any organisation or person outside of us unless you have authorised us to do so.
NO SALE OF PERSONAL INFORMATION
Under no circumstances will Mardell sell or receive payment for licensing or disclosing your personal information.
SECURITY
The security of your information is important to Mardell. We have implemented generally acceptable standards of technology and operational security to ensure personal information (in both physical and electronic form) is protected against loss, misuse, interference and unauthorised access.
Only authorised personnel and contractors are provided access to personal information and have agreed to ensure the confidentiality of this information. Reasonable steps are taken to destroy any personal information that is no longer required or personal information that has not been accessed or used by Mardell for five years.
You should however be aware that the internet is not a secure environment and information sent via the internet (including email) cannot be guaranteed to be totally secure. Mardell will not be liable for any claim, expenses, cost, liability, fee, charge or damages or loss including consequential or special losses (whether direct or indirect) suffered by you where your personal information is fraudulently used or is used in an unauthorised manner.
DATA QUALITY, ACCESS AND CORRECTION
Access
You may at any time, request access to personal information that Mardell holds about you by making a request to our Privacy Officer at the address or email address below.
Mardell will endeavour to process any requests for access to personal information within a reasonable period of time. Where possible, we will provide you with access to that information either by providing you with copies of the information requested, allowing you to inspect the information requested, or providing you with a summary of the information held. If we need to deny your request for access we will let you know why and inform you how you may lodge a complaint regarding this decision. Generally this will only be in cases where providing access would be unlawful or is subject to a potential legal claim or proceeding.
Mardell may charge a reasonable administration fee for supplying personal information.
Correction
If you discover or suspect that there is an error in the personal information that Mardell holds on you or information is missing, please forward your request for correction to our Privacy Officer in writing at the address or email address below. Our Privacy Officer will consider your request and as soon as practicable manage the correction of your personal information and will update you in writing. If your correction request is refused, our Privacy Officer will provide you within a reasonable period of time the reasons for such refusal and inform you of the complaint process (see below).
DELETION OF YOUR PERSONAL INFORMATION
If you require your personal information to be deleted, please contact our Privacy Officer at the below mentioned address or email address. Note that Mardell may be entitled to keep one back up copy of the information for its internal business operations and processes.
COMPLAINTS ABOUT PRIVACY AND OUR COMPLAINT HANDLING PROCEDURE
If you have any complaints relating to the management of your personal information or if you believe there has been a breach of the APPs by Mardell, please forward your complaint in writing to our Privacy Officer at the address or email address below.
Mardell’s Privacy Officer will consider the complaint and advise you of their decision in writing within a reasonable time from receipt of the complaint. If our Privacy Officer decides that there has been a breach of the APPs, s/he will endeavour to ensure that the breach is rectified within 30 days from the date of the decision and will update you in writing. If the breach has not been rectified within 30 days, then our Privacy Officer will inform our Managing Director in order to resolve the matter.

MARDELL GROUP PRIVACY COLLECTION STATEMENT
Mardell Group Pty Ltd ACN 662 193 553 (Mardell, we, us) collects, holds, uses and discloses your personal information when you:
1. Procure our services
Mardell collects information including your company name and contact details, authorised officer details and trade registration.
Mardell will use the information you provide for the purpose of
(i) registering you for an account;
(ii) providing the services;
(iii) having a third party subcontractor provide the services;
(iv) completing any customs or other government or third party carrier forms; and
(v) communicating with you regarding our services.
2. SUBMIT AN ENQUIRY, PROVIDE FEEDBACK OR MAKE A COMPLAINT TO US
Mardell collects information including your name and contact details.
Mardell will use the information you provide for the purpose of:
(i) responding to any enquiries, feedback or complaints made by you; or
(ii) managing our relationship with you, including providing you with information about our services that may be of interest to you.
3. MAKE A PURCHASE THROUGH MARDELL
Mardell collects information such as your name, email address, postal address, telephone number and payment details.
Mardell will use the information you provide for the purpose of:
(i) dealing with and processing your purchase, including to communicate information such as returns or exchanges or changes to delivery arrangements;
(ii) delivering the service to you; and
(iii) communicating with you our services that may be of interest to you.

Mardell collects information that is relevant to employment including your name and contact details including your residential address, phone number and/or email address and any other information relevant to the recruitment process such as the details included on your resume.
Mardell will use the information you provide for the purpose of:
(i) recruitment, assessing and administering your application for employment.

Mardell may disclose your information to our related companies and/or third parties associated with us such as subcontractors, for any of the above purposes or otherwise as stated in our Privacy Policy. If you choose not to provide the requested information or do not agree to our disclosure of any of your personal information this may prevent us from fulfilling these purposes.

(i) how you can access or correct information we hold about you;
(ii) how you can opt out of future communications;
(iii) how you can make a privacy related complaint;
(iv) how that complaint will be dealt with; and
(v) the extent to which your information may be disclosed to overseas recipients.
